Striving for Fairness in a Challenging Unbalanced Patent System

Innovation: Balancing the Equation for Success

Innovation is much like solving a complex equation. It requires hard work, knowledge, and a positive attitude, all working together to yield success. But what happens when the system subtracts from your efforts, leaving you struggling just to stay in the equation?

This is my story—a journey of innovation, resilience, and ultimately, adversity. But it’s more than just my personal experience. It’s a call to action for everyone invested in the future of American ingenuity. Together, inventors, advocates, policymakers, organizations like US Inventor, Spark Innovation, and the Association for American Innovation, and agencies like the Small Business Administration (SBA) can unite to ensure that innovation thrives in the United States.

The Equation for Success

When I founded 360Heros Inc., my goal was to create an affordable 360° camera that would redefine how we capture the world. Like many inventors, I followed a formula for success rooted in dedication, expertise, and a belief in my vision.

Let’s illustrate this in numbers, assigning each letter of the alphabet a value (A=1, B=2, …, Z=26):

  • H-A-R-D-W-O-R-K = 98%
Hard work transformed a concept into reality.
  • K-N-O-W-L-E-D-G-E = 96%
Knowledge provided the foundation for a patented, globally recognized product.
  • A-T-T-I-T-U-D-E = 100%
A positive attitude enabled me to push through challenges and believe in the potential of my invention.

This formula propelled my invention to global recognition, including a 2015 Guinness World Record. But as I soon discovered, success isn’t always defined by the strength of your ideas.

When the System Subtracts

Shortly after our product launch, GoPro—an industry giant—used tactics designed to overwhelm small competitors like me. Legal actions and resource-draining disputes weren’t about justice; they were about elimination. As one market observer noted, this strategy aimed to ensure smaller companies “will not survive the fight.”

Despite holding a valid patent, I faced a system that didn’t protect small inventors. Instead of fostering fair competition, it rewarded financial power over genuine creativity. Legal complexities and predatory tactics shifted the equation, introducing new elements:

  • B-U-L-L-S-H-I-T = 103%
Unnecessary legal obstacles drained resources and stifled innovation.
  • A-S-S-K-I-S-S-I-N-G = 118%
Deference to corporate giants undermined the merit of ideas and innovation.

The result? Despite tireless effort, the system failed to protect my invention or my company, forcing me to step away from the enterprise I built.

The Role of Advocacy and Policy

Organizations like US Inventor, Spark Innovation, and the Association for American Innovation are essential to leveling the playing field. They champion small inventors, advocating for balanced patent policies and fair regulations that enable innovation to flourish. But they can’t do it alone. The SBA, legislators, and other stakeholders must recognize the challenges facing inventors and act to protect their contributions to the economy.

Without these efforts, measures like the PREVAIL Act could further stack the system against inventors, allowing foreign competitors to dominate and threatening America’s status as a global leader in innovation.

Protecting American Innovation

Innovation is what drives progress, and the values that fuel it are clear:

  • D-E-D-I-C-A-T-I-O-N = 104%
Dedication propels inventors to overcome obstacles.
  • I-N-N-O-V-A-T-I-O-N = 123%
Innovation pushes us to imagine new possibilities.
  • P-E-R-S-E-V-E-R-A-N-C-E = 131%
Perseverance ensures that creativity outlasts adversity.

But without systemic fairness, even the most dedicated inventors face an uphill battle. When the SBA invests in small businesses, it’s not just funding a company—it’s supporting a vision for the future. Yet, if that vision can be dismantled by aggressive corporate tactics, what message does that send to the next generation of innovators?

A Call to Action

Inventors are the backbone of American progress. To protect their contributions, we must rally behind organizations, legislators, and the SBA to create a fairer system. Balanced patent laws, stronger protections, and support for small businesses are essential to ensuring that innovation can thrive.

The math is simple: If the system favors only those at the top, America’s capacity to innovate diminishes. But by rebalancing the equation, we can ensure a future where every new idea has the potential to grow exponentially.

Let’s solve this equation together—for the inventors, the dreamers, and the future of American ingenuity.
